This page contains the Company’s Earnings and Results Disclaimer and its Refund Policy. Both apply to your use of the Site and any purchase of Company products or services.

Earnings and Results Disclaimer

This Earnings and Results Disclaimer applies to all information, testimonials, case studies, career descriptions, results statements, and representations of outcomes displayed on www.fractionalga.com (the "Site") or in materials distributed by Fractional Growth Advisors LLC (the "Company"). By using the Site, purchasing any digital product or subscription, participating in any community offered by the Company, or engaging the Company for any advisory or consulting services, you acknowledge and agree to the terms of this Disclaimer.

1. Career Achievements Are Not Client Outcome Guarantees

The Site includes statements regarding the career achievements of the Company's principal, Jeffrey Osborn, over his 35-plus years of experience in technology revenue leadership. These include, without limitation, references to:

  • Growing a pipeline from approximately $80 million to more than $300 million
  • Scaling multiple technology startups from zero to $50 million or more in revenue
  • Building a $500 million global vertical at a multi-billion dollar consulting firm
  • Leading global sales organizations with revenues up to $400 million

These statements describe results achieved by Jeffrey Osborn in prior roles at prior employers, under specific market conditions, in specific industries, with specific team compositions, and over specific time periods. They are provided on the Site for illustrative and informational purposes only, to convey the scope and depth of the principal's prior experience. They are not a prediction, representation, promise, or guarantee of any specific result you or your business will achieve by purchasing any Company product, joining any Company community, or engaging the Company for advisory services.

2. Your Results Will Vary

Any revenue, sales, pipeline, growth, scaling, or other quantitative figures referenced on the Site, in Company materials, in training programs, in presentations, or in any other Company communication are illustrative and example-based only. Your results will vary and will depend on many factors, many of which are outside the Company's control. These factors include, but are not limited to:

  • Your industry, market, and competitive environment
  • The size, stage, and financial position of your company
  • The capability, cohesion, and commitment of your team
  • Your personal experience, expertise, and work ethic
  • Your execution of any plan, framework, or recommendation
  • Your internal change management and adoption efforts
  • The time and resources you devote to implementation
  • Existing systems, processes, data quality, and technology infrastructure
  • External economic, regulatory, and market conditions
  • Factors unique to your business that the Company cannot foresee or influence

Because these factors vary across every individual and every organization, the Company cannot and does not warrant, represent, or guarantee your success, revenue, pipeline growth, profitability, or any other specific business outcome. You accept sole responsibility for evaluating your own business potential, for executing your own business plan, and for the outcomes of any decisions you make in reliance on Company materials or services.

3. Testimonials

Testimonials, case studies, and statements of client experience that may appear on the Site reflect the experiences of specific individuals or organizations and are not representative of what you or any other user or client will experience. Where testimonials are displayed on the Site, the Company represents that such testimonials are:

  • Voluntarily provided by the individual or organization making the testimonial
  • Not compensated; the Company does not pay for testimonials, nor does it provide free products, services, discounts, or other benefits in exchange for testimonials
  • Representative of the specific experience of the specific individual or organization providing the testimonial, based on that party's own efforts, actions, capabilities, and circumstances

The exact results and experiences of any user or client will be unique and individual based on that person's or organization's own efforts, actions, and circumstances, and will differ from the experiences reflected in any testimonial.

4. No Professional Advice

Content on the Site, including frameworks, diagnostics, case studies, and written or video educational materials, is provided for general informational and educational purposes only. Content is not legal, tax, accounting, investment, financial, or other professional advice specific to your situation. You should consult appropriate licensed professionals regarding your specific circumstances before making any business, financial, legal, or operational decision based on Content available on the Site.

5. Advisory Engagement Terms Control

Where you engage the Company for paid fractional chief growth officer, consulting, advisory, or related professional services, the specific terms of that engagement, including the scope of services, deliverables, performance expectations, and any representations about outcomes, will be set forth in a separately executed written engagement agreement between you or your organization and the Company. This Disclaimer governs generalized results statements and testimonials; specific engagement terms are governed by the applicable engagement agreement.

6. Acknowledgment

By using the Site, purchasing any Company product or subscription, or engaging the Company for any service, you acknowledge that you have read and understand this Disclaimer, that you have not relied on any representation of specific outcomes not expressly set forth in a written agreement, and that you accept sole responsibility for your results.

7. Updates

The Company may update this Disclaimer from time to time by posting a revised version on the Site. Your continued use of the Site following any such update constitutes your acceptance of the updated Disclaimer.

Refund Policy

This Refund Policy describes the circumstances under which Fractional Growth Advisors LLC, a Florida limited liability company (the "Company"), offers refunds for digital products, online courses, paid community memberships, subscriptions, and other paid offerings (each, a "Product") purchased through www.fractionalga.com (the "Site"). By purchasing a Product, you agree to the terms of this Refund Policy.

1. Refund Window for Digital Products and Courses

The Company offers a fourteen (14) day refund window on digital products and online courses, measured from the date of the initial purchase. To request a refund within the 14-day window, you must Contact Us with the subject line "Refund Request" and include your order confirmation, the email address used to make the purchase, and the reason for your refund request. Refunds will be processed to the original payment method within a commercially reasonable time after the request is approved.

Due to the digital nature of the Company's products, no refunds will be offered after the 14-day period has elapsed, regardless of the reason for the request, except where required by applicable law.

2. Subscriptions and Recurring Memberships

Subscriptions and recurring memberships (including paid tiers within the Founder Freedom Collective) may be cancelled at any time via the account management features of the applicable platform or by using our Contact Us page. Cancellation takes effect at the end of the current billing period.

The 14-day refund window in Section 1 applies to the initial purchase of any subscription. After the 14-day initial window, no prorated refunds will be issued for partial billing periods, for unused time within a billing period, or for any portion of a paid membership term, regardless of your usage of the subscription. You will retain access to the subscribed services through the end of the current billing period after cancellation.

3. Payment Plans

If you elect to purchase a Product using a payment plan, you are legally obligated to complete all scheduled payments in full, regardless of your continued use of or access to the Product. Cancellation, loss of interest, technical issues you have not reported to the Company within the 14-day refund window, or non-use of the Product does not relieve you of your obligation to complete the payment plan.

The Company reserves the right to pursue recovery of any amounts remaining unpaid on a payment plan, including through collections agencies, legal proceedings, and the recovery of reasonable attorneys' fees and costs incurred in such collection efforts. The Company may report delinquent accounts to credit bureaus and collections agencies in accordance with applicable law.

4. Items Not Eligible for Refund

Notwithstanding any other provision of this Refund Policy, the following are not eligible for refund:

  • Paid fractional advisory, consulting, fractional chief growth officer, and other professional services engagements, which are governed exclusively by each separately executed written engagement agreement and not by this Refund Policy
  • Purchases for which the 14-day refund window has elapsed
  • Subscription payments for billing periods that have already been paid, where cancellation occurred after the 14-day initial window
  • Custom work, custom-developed materials, or bespoke deliverables produced at your specific request
  • Purchases cancelled or disputed through a chargeback rather than through the Company's refund process; the Company reserves the right to dispute chargebacks with the applicable card network and to recover associated costs
  • Products that have been substantially consumed, downloaded, or otherwise accessed in a manner that materially reduces the Company's ability to resell the Product

5. How to Request a Refund

To request a refund within the applicable refund window, please contact the Company via our Contact Us page with the subject line "Refund Request" and include:

  • Your full name
  • The email address used to make the purchase
  • The Product purchased and date of purchase
  • Your order confirmation number, if available
  • A brief explanation of the reason for the request

The Company will review your request and respond within a reasonable time. Approved refunds will be processed to the original payment method. Depending on your payment provider, refunds may take several business days to appear on your statement.

6. Fraud and Abuse

The Company reserves the right, in its sole discretion, to deny refund requests that it determines, in good faith, to be fraudulent, abusive, or inconsistent with the intent of this Refund Policy, including requests made repeatedly by the same user or requests that reflect a pattern of purchase-and-refund activity inconsistent with good faith use of the Products.

7. Relationship to Terms and Conditions

This Refund Policy is incorporated into and made part of the Company's Terms and Conditions. In the event of any conflict between this Refund Policy and the Terms and Conditions, this Refund Policy shall control with respect to refund matters.

8. Changes to This Refund Policy

The Company may update this Refund Policy from time to time by posting a revised version on the Site. Your continued use of the Site or purchase of any Product following any such update constitutes your acceptance of the updated Refund Policy. The Refund Policy in effect at the time of your purchase will govern that purchase.

9. Questions

If you have questions about this Refund Policy, please contact the Company via our Contact Us page.
